Foul on Big Baby with 2min in the 3rd

Correct my if I am wrong, but if a player fouls another player who is either in the air or leaving his feet, and IS NOT making a play on the ball, it is considered a flagrant foul. Glen Davis just made a driving layup attempt with 2:02 left in the 3rd period with Michael Pietrus shoving him full strength in the lower back to prevent an easy basket, which sent Big Baby sprawling. He got right up, rightfully upset, but there was no indication that refs even considered it a hard foul. The baseline ref was 12 inches from the play so he certainly saw it - he blew the whistle. What gives? What if Baby lands on his head on this play?

Long time reader here, and I rarely post, but I had to chime in on this one. Maybe its the vodka and orange Sunkist soda talking?
